Good Morning,

We have had a few inquiries lately regarding the statutory requirement concerning space for recycling in the new development of multifamily and commercial properties. The requirement can be found in 403.706(2)(c)F.S. <http://www.leg.state.fl.us/statutes/index.cfm?mode=View%20Statutes&SubMenu=1&App_mode=Display_Statute&Search_String=403.706&URL=0400-0499/0403/Sections/0403.706.html> Please see statute below:

403.706(2)(c)<http://www.leg.state.fl.us/statutes/index.cfm?mode=View%20Statutes&SubMenu=1&App_mode=Display_Statute&Search_String=403.706&URL=0400-0499/0403/Sections/0403.706.html> F.S. In accordance with applicable local government ordinances, newly developed property receiving a certificate of occupancy, or its equivalent, on or after July 1, 2012, that is used for multifamily residential or commercial purposes, must provide adequate space and an adequate receptacle for recycling by tenants and owners of the property. This provision is limited to counties and municipalities that have an established residential, including multifamily, or commercial recycling program that provides recycling receptacles to residences and businesses and regular pickup services for those receptacles.

If you have any questions regarding this statute, please let us know.

Sincerely,
Karen
