Did you have any difficulty working with the Police Dept. regarding them
taking the controlled substances?  If so, how did you overcome it?

Hi all,
Everything that Richard says is the same as our understanding in Maine =
about
how controlled substances must be handled except I have never heard of =
"some
correspondence from the DEA that indicates "..controlled substances =
cannot
be commingled with the non- controlled substances..".  Correspondence is =
not
the same as statute or regulations, nor even department policy. If =
possible
it would be good to know more about what correspondence, when and by =
whom
etc.  In fact this is different from what Vicki Seegars, (DEA =
Washington)
has said, where as long as you do not "knowingly" accept controlled
substances, it would be ok to collect any unwanted medications at a
collection event.
 Maine collections that have involved my office have taken the safeguard =
of
separating controlled meds and sending them off with a police officer, =
and
we will continue to do so. Still we came to an understanding that a
collection could happen that co-mingled controlled and non-controlled =
and
everything would be Fed-exed at the end of the event for a witnessed =
burn.

One question - how do people know if their prescription is controlled?  =
For
instance, Ritalin is a controlled substance, but many parents/patients =
do
not know that. This adds to the problem in that it requires public =
education
to keep these pharmaceuticals separate.

for local law enforcement acting in official duty.  **The =3D20=3D

police department you mention would be accepting controlled =3D20 =
substances
(versus the pharmacy.)**  This little distinction is =3D20 important for =
all
to know.

Additionally, there has been some correspondence from the DEA that =3D20

We call this issue "the DEA obstacle", and we brought this matter up =

as a regulatory roadblock, not allowing for an efficient means of =3D20
recapturing unwanted controlled substances - thus hindering the =3D20 =
entire
pharmaceutical collection effort.

DEA's response was well received, and we believe that DEA recognizes =
=3D20
more each year that this as an issue that must be addressed. DEA is =
=3D20
hand-tied because the law simply doesn't allow for distribution/=3D20
transaction between the consumer (non-registrant) and any other =3D20 =
entity
(except law enforcement as we have seen).

DEA, understandably, has reason to be wary of this sort of =
'reverse-=3D20
distribution; however, they also clearly see the net benefit.

So, a change must be made to the law that restricts the transactions =
=3D20
from consumers. Specifically, we are suggesting 21 CFR part 1307.21, =
=3D20 and
related affected sections, be modified to achieve the goal.  =3D20 =
Strong will
work with DEA to suggest and implement a regulatory =3D20 mechanism that
achieves the mutual goals of properly governed disposal.

Unfortunately the markings for a controlled substance are only on the
original manufacturer's package, indicating a CII, CIII, etc. There are =
no
specific markings on the  prescription label. That is why a pharmacist =
is
needed to identify which drugs can be accepted at a collection site. A
change in the Controlled Substances Act is needed and the Drug =
Enforcement
Administration is beginning to consider such as change.=3D20

requirement for local law enforcement acting in official duty.  **The

police department you mention would be accepting controlled =3D3D20 =
substances
(versus the pharmacy.)**  This little distinction is =3D3D20 important =
for all
to know.

Additionally, there has been some correspondence from the DEA that =
=3D3D20
indicates "..controlled substances cannot be commingled with the =3D =
non-=3D3D20
controlled substances..." during these unwanted medication disposal =3D =
=3D3D20
projects.


We call this issue "the DEA obstacle", and we brought this matter up =3D =
=3D3D20
two weeks ago with the DEA.  While on an invited panel discussion =
=3D3D20 with
the headquarter DEA folks, Strong characterized the current laws =
=3D3D20=3D3D

as a regulatory roadblock, not allowing for an efficient means of =
=3D3D20
recapturing unwanted controlled substances - thus hindering the =3D3D20 =
entire
pharmaceutical collection effort.

DEA's response was well received, and we believe that DEA recognizes =3D =
=3D3D20
more each year that this as an issue that must be addressed. DEA is =3D =
=3D3D20
hand-tied because the law simply doesn't allow for distribution/=3D3D20
transaction between the consumer (non-registrant) and any other =3D3D20 =
entity
(except law enforcement as we have seen).

DEA, understandably, has reason to be wary of this sort of =3D =
'reverse-=3D3D20
distribution; however, they also clearly see the net benefit.

So, a change must be made to the law that restricts the transactions =3D =
=3D3D20
from consumers. Specifically, we are suggesting 21 CFR part 1307.21, =3D =
=3D3D20
and related affected sections, be modified to achieve the goal.  =3D3D20
Strong will work with DEA to suggest and implement a regulatory =3D3D20
mechanism that achieves the mutual goals of properly governed disposal.
