I checked with my various sources, and the person I spoke with had been
misinformed. Apparently the concern from another counterpart of mine is that
the DEA regulations haven't been promulgated yet to specify what take back
programs are supposed to do, and the real concern was that take back
programs nationwide are illegal. I explained that as long as the special
agent in charge at the local DEA office has approved of the take back
program, it shouldn't be an issue. Sorry for the weird question - it was
just SO weird that I needed to double check with you all. Thanks!!
Anything collected from households here in NM, even if it is technically a P
or U listed waste, is still considered household hazardous waste, so there
is no stipulation on having to separate things out before incineration.
However, we are one of the few states that doesn't (at this point) allow
incineration of most things.

Hi Sarah,
I suspect this is misinformation. If the regulation is federal, there would
be many violators. I know of no current EPA or DEA regulation pertaining to
the restriction of incinerating controlled substances.

Does anyone know of a federal regulation that prohibits the incineration of
controlled substances? This is information I heard this morning, but the
person I spoke with didn't have any more information than this.
