Generally speaking in most states, that is not the case.   In our state and
under Federal Hazardous Waste rules, the exemption to RCRA follows the
waste.  So if a household hazardous waste is exempt from RCRA Subtitle C
under the Household Waste exclusion, it is still exempt at a community
collection event from RCRA.  There are some states that do have rules that
are more stringent than the Federal Hazardous Waste rules and your state,
Massachusetts, may be one of them.  However, for many if not most states,
the household waste is still exempt from Subtitle C, when it is collected
by a household hazardous waste collection program.

Recently I had a discussion with folks at DOE.  Selenium is "hazardous
waste" so I asked what was the scoop on Selsun Blue etc.  It is fine for an
individual to have bottles of it but if a community event collects them
then it is hazardous.  There is a lot that is confusing.
