Hi Bill,

I attended the meeting with the DEA, DOT, EPA in Arlington, VA back in July of 2015 and Mr. Prevoznik was present at this meeting along with Ruth Carter from the DEA.  DOT was just getting involved at that time based on the consumer program as they were wanting to know how the packages would be classified for shipment.  I worked directly with Andrew Eckinrode from the DOT as I am guessing Jan did as well.  Each authorized collector would be required to be party to 20255 if this was the only available permit, however, because DOT approved the Special Permit after 20255 which is a Manufacture, Mark, Sale and Use permit for approved packaging, each authorized collector utilizing this approved packaging would not be required to become a party to this Special Permit, just to keep this Special Permit on hand at their collector site.

Hi Doug (Bowman) & Jan (Harris) –

Where I’m coming from in my 10:57 email below is based mainly on the attached June 2016 email from DEA’s Tom Prevoznik (which was distributed in a pharmwaste listserv email last July). Mr Prevoznik says in that email:

“If…the retail pharmacy…is shipping via common carrier then the…retail pharmacy…would be the responsible shipper and they would be responsible for obtaining the special permit.”

So when Jan described in her 12:28 email the situation where the collected pharmaceuticals were “…completely under the control of the registered collector (pharmacy), with common carrier …” I wanted to raise the red flag that such an arrangement would definitely appear to require that the pharmacy become a party to 20255 (or to Doug’s 20295 or to Jan’s 20284).

I concur with Jan on her statement below as Assured Waste Solutions also has its own unique DOT Special Permit (20295) as well as grantee status to 20255.

Thanks William for the question,

Sharps has its own unique Special Permit from DOT (SP 20284). This prevents our collector pharmacy customers from having to get their own SP20255. If a reverse distributor using common carrier does not have their own SP, you are right that the pharmacy would have to apply as party to SP 20255.

If Sharps Compliance uses a common carrier, doesn’t that then force each pharmacy to get DOT approval to use Special Permit SP 20255 to stay in compliance with DOT regulations?

One of the reasons Sharps Compliance chose to use the common carrier method, besides the liability and requirement for two reverse distributor drivers, is that the receptacle fills up often and then has to be locked up for several days until a pickup service arrives. So besides being completely under the control of the registered collector (pharmacy), with common carrier, the pharmacy has back-up liners that can be easily replaced when necessary, which is more convenient for the public.

Actually the Sharps Compliance MedSafe program is a common carrier system. Two registered collector, (e.g., retail pharmacy) employees remove the inner liner, close it up, and provide directly to UPS. We do not have a pickup program for our DEA-compliant receptacle program.

That’s how it works. They are permitted by DEA to handle the collected liners, so they replace them, while pharmacy staff watch so everything is above board. I believe they are servicing the Walgreens collection sites here in MN. The Sharps Compliance system operates the same way.

This is interesting. The system is apparently entirely managed by Stericycle. The article indicates a “technician” (i.e. Stericycle rep) will come to empty the kiosk while two people from the pharmacy site are present. It’s not crystal clear, but sounds like that technician then ships the liner. The video panel is interesting with the ability to provide directions in different languages.
