As of December 30, 2016, an Administrative Law Judge invalidated a proposed pollution notification rule promulgated by the Department, which required owners of installations throughout the State of Florida report pollution events to the local government as well as a local media outlet to notify the general public of the event. Protecting Florida's pristine environment is our top priority and DEP will continue the public pollution notification process to ensure all Floridians and visitors are notified of pollution incidents. Moving forward the notification process from the Department may change, however it was imperative that the notification to the public continued seamlessly. The incident below was reported to the State Watch Office and is being forwarded to you because the event has occurred in your area. Initial Report: PER NRC FAX #1169163 "VERBATIM" A FIRE IGNITED IN THE PLANTS NITRIC UNIT, DUE TO UNKNOWN CAUSES. AS A RESULT, OIL HAS DISCHARGED FROM THE UNIT, INTO STORM DRAINS WITH A POTENTIAL IMPACT TO THE ESCAMBIA RIVER. NO INJURIES OR EVACUATIONS INVOLVED. REMEDIAL ACTIONS * FIREFIGHTING EFFORTS UNDERWAY. * STORM DRAINS HAVE BEEN COVERED, BOOMS DEPLOYED IN THE DITCH SYSTEM.

NWD OER staff spoke with facility rep. She indicated that they had a fire on a compressor which allowed the release of as much as 2000 gallons of oil from a compressor sump, and the sump was overflowed by firefighting water. The water flowed into a storm drain that was diverted and booms were put in place to prevent the oil from entering the River.
SwS and USES have been hired to ensure no oil made it into the River. They are bringing a skimmer and a vac truck to the site also to remove the oil from the ditch.
Also spoke with the Incident Commander on scene. He indicated they were certain that the oil had not made it to the river and the storm drain was secure. As a precaution they still intend to put a contractor boat in the river and check to ensure no oil made it off site.
