As of December 30, 2016, an Administrative Law Judge invalidated a proposed pollution notification rule promulgated by the Department, which required owners of installations throughout the State of Florida report pollution events to the local government as well as a local media outlet to notify the general public of the event. Protecting Florida's pristine environment is our top priority and DEP will continue the public pollution notification process to ensure all Floridians and visitors are notified of pollution incidents. Moving forward the notification process from the Department may change, however it was imperative that the notification to the public continued seamlessly. The incident below is being forwarded to you because the event has occurred in your area.      *   Installation Name: US 19 Reconstruction in Homosassa

     *   Date and time of incident: 1/21/2017 around 11:51am
     *   Suspected source and cause of incident or discover: Breech of storm water pond berm.
     *   Type of pollution, including substance or contaminant names: Storm water
     *   Amount of pollution: Unknown at this time.
     *   Medium affected by pollution: Water and land.
     *   Potentially affected areas beyond installation property boundary: private property along tributary plus other locations downstream.
     *   Potential risk to the public health, safety, or welfare: Unknown.
     *   Identification of parties notified of incident and time notification occurred.  Shannon Herbon, Department of Environmental Protection, Saturday, January 21, 2017 at 11:51am.
     *   Any other information that may be helpful: Department staff investigated on January 24, 2017.  Spoke to responsible party and advised of corrective actions that need to be implemented immediately.  Investigation is still on-going.
