A new U.S. EPA rule broadening the definition of solid waste recycling =
to
include previously regulated waste from certain industrial sectors has =
been
delayed temporarily as the agency works to finalize details of the rule,
officials said this week.=20
EPA had planned to unveil the rule at this week's national Resources =
Recovery
and Conservation Act meeting in Washington. But the agency pulled the =
item
from the agenda because it is not certain it will finish the rulemaking
process by the end of this month, as previously expected.
Under the proposed rule, materials like waste oil from refineries and =
mining
wastes that are currently subject to RCRA regulations could become =
exempt
from regulation as recyclable materials.
The proposed rule change stems in part from an April 2000 ruling by the =
D.C.
Circuit Court of Appeals in Association of Battery Recyclers, Inc. et =
al. v.
EPA. In that decision, the court held that EPA had defined recycling too
narrowly in its implementation of RCRA.
"The purpose of the rule is once and for all to legitimize recycling of
certain industrial materials," said Robert Springer, director of EPA's =
Office
of Solid Waste. While declining to discuss what materials or industry =
sectors
the rule would cover, Springer said it was aimed at more than just =
battery
recycling.
But Leslie Hulse, an attorney for the American Chemistry Council, said =
the
2000 court ruling may offer some clues as to the direction EPA is =
heading
since the judge identified several types of materials wrongfully =
regulated as
solid waste by EPA.
One is specialized dusts that mining companies use to process metals. A
mining facility "typically recaptures, recycles, and reuses these dusts,
frequently in production processes different from the one from which the
dusts were originally emitted," according to the D.C. Circuit decision.
Another item mentioned by the court is undiscarded oil that refiners =
sell as
fuel for boilers.=20
