Hi Everybody,

Please see the following announcement of our recently-published memo addressing unused hand sanitizer reclamation with respect to the industrial ethyl alcohol exemption. If you have questions, please contact Kristin Fitzgerald (fitzgerald.kristin at epa.gov<mailto:fitzgerald.kristin at epa.gov>).

In scenario #5 on page 5 of our November 17, 2022, memorandum<https://secure-web.cisco.com/1OoAK1u6HD4OB4NSlODNY7n4VvVJ2VN3C6HAhimP4ce75APYLL-cWTys7uFhX4xwfk2mQlTNvBM59kDhdHe_lU2kR8UvZ9AlrYO8GBddkuMWzWwJcJemCAWgzidHWBlusH9Nir-Pdvp29iRiR4slA98RKPUvNMlv2yXyRmBZxzsG5LT3S95_59BK4JhyGT9g9Q-uKGyWMdQkUpr5JLwUY95iQixCcOcU-U3heYEK-QMfIPAduW0oa3M-RA4ktFkBXV01v8Ql4Ak_1ardEbrOtWIW-mXVqj0bVEuBsa6FupOP5u1gyrUzyDmiVNg9RDCAB/https%3A%2F%2Frcrapublic.epa.gov%2Frcraonline%2Fdetails.xhtml%3Frcra%3D14953>, EPA discussed the exemption for reclaimed industrial ethyl alcohol, stating that the industrial ethyl alcohol must be spent in order to qualify for the recycling exemption. After our discussions with Dynamic Recycling and interested states, EPA has reconsidered our position in the November 17, 2022, memorandum and we have concluded that unused industrial ethyl alcohol, including unused alcohol-based hand sanitizer, also qualifies for this exemption.

See the new memo, RCRA Online #14955<https://secure-web.cisco.com/1GsvsIarcpozfH3n0uVmuekZZQ5LJBQtoUsVw60bzVJ5ouI7djVK-JVojDM1YCLkj6LXN7WmxpueezdcxY_eKFtjSF3T2S3lH9oMgRctDZA_UdghtNmtotXUeb_NWOvtpZuM6Ir-54RdqkcCJqnw7-8-XpUnjdWMW-YAKvZdVo3BwhHSr97jHJKhzrjFHORzPKvZX7yTNJ9x2-4FNT-AGkIPNMNuePFQMRwnFKyljB0c_TJQBFZf702S7NUzL8-PDMsfCD5o3rhcZbZ966ZZsYtW3tfyXTMHpZvbKjSK8RznN_xVLEQrEJ5kChgzSl1Uv/https%3A%2F%2Frcrapublic.epa.gov%2Frcraonline%2Fdetails.xhtml%3Frcra%3D14955>, signed on May 5, 2023, for EPA's updated interpretation of the industrial ethyl alcohol exemption.
