That is a distinct possibility, Bill. I can only speak to the institutions in my local area where I’ve had some experience with the individual regulatory agencies and regulated institutions. It has been my experience the Washington folks (Dept. of Ecology) treat the state penitentiaries at Coyote Ridge and Walla Walla as regulated businesses. Idaho has taken the same stance with their Cottonwood facility. Caveat: Last direct experience ca. 2007
If we have list members from AK or IA they could perhaps better speak to the viewpoint of the federal regulators as their states rely upon the USEPA and RCRA without modification or influence of state programs.

Instead of a hospital, do you think a closer fit would be a long-term care facility?
[EPA has said that residents in long-term care facilities enjoy the household waste exclusion (12/2/08 FR p 73525).]

To me the prison setting most closely resembles a hospital. The cells are more akin to hospital rooms than to hotel, dorm, or bunkhouse rooms where property owners have little control over the activities of individual residents.

I think we would say that it’s household hazardous waste, as long as it’s generated by the inmate in his cell, and not, say, by a medical care provider in a prison infirmary or hospital.

How does your state classify waste generated by a state corrections prisoner in his cell? Household Waste(like residential waste) or Institutional Waste?
