[Pharmwaste] MO allowing collection while preempting EPR

Soon, only two states will still have rules that prevent pharmacies from doing DEA authorized take-back.

MO is about to pass legislation to clear the way for pharmacy take-back.  Law enforcement is very active there.

I missed when in the last year AK changed their rules to become compliant with the DEA rule.

That leaves only CT and HI barring DEA authorized take-back.

The MO bill now goes back to the Senate to resolve differences.

The House version requires the state to develop an education and awareness program (i.e. taxpayer funded).

The bills are supported by pharmaceutical manufactures.

Both versions include preemption,  "This subsection shall supersede and preempt any local ordinances or regulations, including any ordinances or regulations enacted by any political subdivision of the state, regarding the disposal of unused controlled substances."



My read is that the bill allows pharmacies to do take-back, may or may not end up requiring a taxpayer funded education and awareness program, and preempts any local take-back bill, which would include EPR.

Am I mistaken?  Anyone have more detailed information?  Thanks!
